Can you use WhatsApp messages as evidence at NCAT (NSW)?
Last reviewed 30 October 2026
NCAT's evidence page says it generally does not accept evidence by email, and asks you to label documents and number attachments in the order you refer to them. It names emails, photos and video, but not text messages or screenshots. Ask the Registry how it wants WhatsApp messages presented before your hearing.
What did we check?
We read NCAT's "Evidence and witnesses" page on 30 October 2026. We haven't checked division-specific directions, and we can't tell you whether NCAT will accept your messages or how much weight they'll get. That's NCAT's call.
How do I get documents to NCAT?
- Not by email. The page says NCAT "generally does not accept the filing of submissions or evidence by email".
- Follow the instructions in your hearing notice if they say otherwise.
How should I organise them?
- Put your documents in a folder and label them.
- Bring copies for the other parties.
- Attach and number documents in the order you refer to them.
- Number the pages inside each one, so you can say "attachment 2, page 4".
The page also says giving false evidence is an offence.
Will NCAT accept a WhatsApp export or screenshot?
We can't say. The page doesn't mention text messages or screenshots, and silence isn't a ruling either way. Ask the Registry, check your notice, and consider a community legal centre or a lawyer if a lot is riding on it.
How do I make one clear record?
- Export the chat. See how to export a WhatsApp chat to PDF with dates.
- Open Make a pack, pick the messages that matter and add a line to each.
- Print the key messages in date order, with page numbers.
- Run Check a pack to confirm every quote matches the export.
VaultXT runs on your device, so your messages aren't uploaded. A pack is a tidy record of what the chat showed on the day. It doesn't make a message more genuine. Only have screenshots? Keep them and export the chat too: screenshot or export.
